Key and Critical Responsibilities
The Senior Legal Counsel is responsible for leading and managing the Commission's legal function and providing strategic legal advice to the Board of Commissioners, the Executive Director and staff on all matters relating to the administration and enforcement of the Fair Trading Act.<div><br></div><div>DUTIES AND RESPONSIBILITIES:</div><div><br></div><div>Provide strategic legal advice to the Board of Commissioners, Executive Director and staff on all legal, regulatory and governance matters affecting the Commission.</div><div><br></div><div><br></div><div>Advise on the interpretation and application of the Fair Trading Act, subsidiary legislation, guidelines and related competition law principles.</div><div><br></div><div><br></div><div>Provide legal advice on merger notifications, market inquiries, abuse of dominance investigations, anti-competitive agreements and other enforcement matters.</div><div><br></div><div><br></div><div>Prepare complaints, briefs and reports, and negotiate settlements as required.</div><div><br></div><div><br></div><div>Advise investigation teams throughout investigations, including evidence gathering, compulsory information requests, search powers, witness interviews and enforcement strategy.</div><div><br></div><div><br></div><div>Present evidence, examine and cross-examine witnesses in proceedings before the Commission.</div><div><br></div><div><br></div><div>Facilitate the preparation and drafting of all legal and legislative documents, including rules, guidelines, contracts and agreements on behalf of the Commission.</div><div><br></div><div><br></div><div>Lead or contribute to the development of competition policy, legislative reform, guidelines, consultation papers and regulatory instruments.</div><div><br></div><div><br></div><div>Represent the Commission in regional and international meetings, negotiations, technical working groups and capacity-building activities where required.</div><div><br></div><div><br></div><div>Deliver legal presentations, stakeholder engagement programmes and advocacy initiatives promoting awareness of competition law and policy.</div><div><br></div><div><br></div><div>Review, negotiate and draft contracts, Memoranda of Understanding, procurement documents and other legal instruments on behalf of the Commission.</div><div><br></div><div><br></div><div>Ensure that the Commission conducts its affairs in accordance with the Fair Trading Act, applicable legislation, principles of good governance and administrative law.</div><div><br></div><div>Perform other duties which may, from time to time, be assigned.</div>
Key Competencies
EXPERIENCE AND QUALIFICATIONS:<div>A Bachelor's Degree in Law and a Legal Education Certificate or its equivalent from a recognized institution.</div><div>Evidence of qualification to practice in Trinidad and Tobago.</div><div>A minimum of 8 years' experience as a practicing Attorney-at-Law in one or more of the following: Commercial Law, Administrative Law, Regulation and Litigation</div><div><br></div><div>Knowledge of Competition Law will be an asset.</div><div><br></div><div>SKILLS AND ABILITIES:</div><div>Proficiency in Microsoft Office Suite</div><div>Strong supervisory skills</div><div>Excellent research skills and written oral communication skills.</div><div>Good advocacy skills</div><div>High ethical standards.&nbsp;</div>
