Job Description
The Legal Officer II will be responsible for providing support to the Legal Department by assisting the Senior Legal Officer in the management of the Authoritys litigation portfolio including but not limited to draft/review contracts, prepare briefs for litigation matters, conduct litigation (Civil, and Employment related), advise and appear at mediation/arbitration hearings, research laws, regulations and legal opinions and provide advice on industrial relations and disciplinary matters, performing professional legal work, appearing in court, providing legal advice and opinions and drafting documents on matters involving the SWRHA, providing leadership and guidance to the Legal Officers. <div><br></div><div>The Authority reserves the right to assign the officer to any Facility under its management. </div><div><br></div>
Key and Critical Responsibilities
Legal/Legislative <div> Arbitration and Mediation </div><div> Instructing and Advocacy work </div><div> Contract Administration </div><div> Interests Protection </div><div> Provides legal advice and opinion with a view to protecting the Authority from legal liability and ensuring the compliance with statutory and common-law requirements. </div><div> Conducts both instructing and advocacy work and attends matters in Courts and Tribunals to eliminate litigation. </div><div> Drafts, prepares reviews, assesses and negotiates contracts, conveyances, leases and other legal documents associated with policy decisions of the Authority in a timely manner. </div><div> Assesses and reviews legal and contractual matters associated with policy decisions of the Authority. </div><div> Develops and/or maintains a legal information database to track and report monthly expenditure payments to Attorneys. </div><div> Ensures fiscal prudence in negotiations when outsourcing legal representation. </div><div> Liaises with external Attorneys as appointed by the Board of Directors and/or the Ministry of Health. </div><div> Interprets laws, ordinances, regulations and agreements and advises on implementation and compliance. </div><div> Participates in consultations/negotiations and provides on the spot advice in matters related to the business of the Authority. </div><div> Represents the Authority at meetings, conferences, workshops and committees and provides guidance. </div><div> Advises/appears at Mediation/Arbitration hearing. </div><div> Liaises with the Human Resources Department with regards to HR matters. </div><div> Ensures that there is compliance with the SOPs and Policies within the department. </div><div> Represents the Authority at meetings, conferences, workshops and court as may be required. </div><div> Discharges the duties of the office of the Legal Officer II and any other related duties that may be assigned by the Chief Executive Officer, the Senior Legal Officer or other duly authorized officer as required. </div><div> Working knowledge of the RHA Act and its Subsidiary Legislations. </div><div> Knowledge of Health Related Laws. </div><div> Sound knowledge of the Rules and Regulations governing the Authority. </div><div> Sound knowledge of Court and Litigation procedures. </div><div> Knowledge of Contract Laws and Industrial Relations Law </div><div> Diploma/ Certificate in Industrial Relations from an accredited institution of at least one (1) year in duration will be an asset. </div><div> Knowledge and experience in Arbitration/Mediation procedures. </div><div> Knowledge of the Code of Corporate Governance for the Health Sector and the Patients Charter of Rights and Obligations. </div><div> Comprehensive knowledge of the Public Procurement and Disposal of Public Property Act and its subsidiary Legislation. </div><div> Ability to perform duties according to assigned rosters or plans that can be formulated in times of authorized service exigencies. </div><div> Ability to use the relevant computer applications related to job functions.</div>
Key Competencies
A Bachelor of Law Degree. <div> Legal Education Certificate (LEC) or Legal Practice Certificate (LPC). </div><div> Admission to practice as an Attorney-at-Law with a minimum of six (6) years experience with three (3) years practical supervisory experience in a large establishment. </div><div> Management training will be an asset. </div><div> Qualification, training and experience in Arbitration and Mediation will be an asset. </div><div><br></div><div> </div>
